COMPETITION RULES


ARTICLE 1. Organisation

The company Toluna SAS, with a share capital of 2,600,000 euros, with its registered office at 1 bis rue Collange 92300 Levallois Perret, registered with the RCS of Nanterre under n° 432033181, is organising a free competition with no obligation to purchase entitled the “Bose QuietComfort Headphones Grand Draw ”, taking place from January 20th to April 20th, 2017.

ARTICLE 2. Participation

This draw is offered to all Toluna members, private individuals over the age of eighteen, in the following countries: France, United Kingdom, Germany, Spain, Russia, Brazil, Australia, Finland, Netherlands, Sweden, Portugal, Turkey, Mexico, Chile, Argentina, Peru, Greece, Italy, Czech Republic, Ireland, Belgium, Austria, Denmark, Norway, Switzerland, Poland, Singapore, Hong Kong, Indonesia, Republic of Korea, Thailand, China, India, Japan, Malaysia, New Zealand, Philippines, Saudi Arabia, Colombia, Taiwan, Pakistan, Hungary, Morocco, and the United States, with the exception of employees and representatives of the organiser company, its client, its subcontractors and its partners, members of their family and their direct or indirect parents or relatives.

To enter, the participant simply needs to have a ticket:

  • The member can exchange 1,000 points for a draw ticket (the number of tickets is not limited)

Participation in the competition is free of charge and is not limited to one entry per household.

To qualify, participants must have a profile image and must be “active” members, which includes (but is not limited to) the creation or participation in an opinion or in a quick vote within the 3 months preceding the draw.
This contest is open to all our mobile app users and is not associated, organised, sponsored, or administrated by Apple or Google.

ARTICLE 3. Prize

A draw will name 7 Toluna members who will win a QuietComfort 35 wireless headphones by Bose (each winner should be choose the colour of his/her headset according to the colours available) – price: €380 or $349

6 members will be drawn randomly and the participant with the most tickets will be named the 7th   winner of this event.
The participant with the most tickets is only eligible to be the automatic winner on three separate occasions. If the participant with the most tickets has already won on three prior occasions as the automatic winner, the prize will be forfeited to the participant with the second largest number of tickets. All participants are eligible to be selected as a winner via the random draw, regardless of the number of prior wins.

 
10 runners-up will also be drawn in order to make up for any default of the winners.   
The winners will be contacted by Toluna and will have 2 weeks in which to accept their prize. 

Toluna SAS reserves the right to change the prize without notice.  If this is the case, the value of the prize will be equivalent to the product replaced.

The winners will be informed by Toluna SAS of the results by email.  The winner authorises all checks on his identity and address (postal and/or internet address).
Any false address or identity information will entail disqualification the winner and the whole of his entry.

ARTICLE 4. Naming of the winners and delivery of prizes

The winner drawn randomly will have completed all his profiles.

The winner will be contacted by Toluna and will have 2 weeks in which to accept their prize. 
The winner will be informed by Toluna SAS of the results by email.  The winner authorises all checks on his identity and address (postal and/or internet address).
Any false address or identity information will entail disqualification the winner and the whole of his entry.


ARTICLE 5. Data Protection

In compliance with the French Data Protection Act of 6 January 1978, participants have the right to access, rectify and delete the data concerning them.  Participants may exercise this right by writing to La société Toluna 1 bis rue Collange 92300 Levallois Perret.

ARTICLE 6. Reimbursement of the entry

Every participant in the competition may obtain reimbursement, on request, of the costs corresponding to the log-in time, on the basis of a connection of 5 minutes at the off-peak rate.  The request for reimbursement must be sent by post to Toluna SAS, accompanied by bank details, evidence of address and an extract of an access provider’s bill indicating the date and time of the connection, no later than 30 days after the competition closing date, with the postmark giving evidence thereof.  The costs incurred by the participant for the stamp necessary to this request shall be reimbursed on simple written request on the basis of the 2nd class “letter” rate in force.  One single request for reimbursement will be accepted per participant registered in the competition and per envelope (same name, same address).

On the understanding that in the current state of service offers and the technique some internet access providers offer a free or flat rate connection to web users, it is expressly agreed that any access to the Website on a free or flat rate basis (such as notably connection by cable, ADSL or specialised connection) shall not give rise to any reimbursement, insofar as the subscription to the access provider’s services is in this case contracted by the web user for his internet use in general, and the fact that the Participant logged in to the Website and participated in the competition did not cause him any additional cost or disbursement.  In the event where the player wishes to be reimbursed for several entries, he must send separate requests for each of his entries.
Photocopies will be reimbursed on request on the basis of € 0.08.  Costs incurred upon sending reimbursement requests shall be reimbursed only on written request at the 2nd class rate in force.

ARTICLE 7. Organiser’s liability

The organiser reserves the right to shorten, extend, modify or cancel this competition if the circumstances so demand.  It may not be held liable for this or for any malfunction of the internet network, routing problems or loss of email.

ARTICLE 8. Application and Filing of the Competition Rules

The rules may be modified at any time in the form of addendum by the organiser, with respect for the conditions stipulated.

The rules shall be sent free of charge to any person so requesting in writing at the following address: Toluna SAS, 1 bis rue Collange, 92300 Levallois-Perret.  The stamp necessary to the request for rules will be reimbursed on simple request on the basis of the 2nd class “letter” rate in force.

ARTICLE 9. Applicable law

These rules are governed by French law.
Participants unreservedly accept that the simple fact of participating in this competition subjects them obligatorily to French laws, notably for any dispute that may arise owing to the competition subject of these rules, or which may be directly or indirectly linked to it, without prejudice to any rules of conflict of laws that may exist.  Any dispute between the parties falls to the exclusive jurisdiction of the Tribunal de Grande Instance of Paris.

Whether or not you are a Toluna member, you can send us a card (3x5) on which you have written your name, address and email address. This card must bear the mention “Free entry” accompanied by the title of the lottery: “Bose QuietComfort Headphones Grand Draw”.
